Dying Intestate


When someone dies without a trust or a legal will it is called dying intestate. If someone dies intestate, the law of the state determines what happens to the deceased person's estate and minor children if there are any. The process is called probate.

Probate is an effort made by the state to be fair in the distribution of property previously owned by the now deceased.
